02 NCAC 48A .0217 FUMIGATION BY PRIVATE PRACTITIONER
(a) No private practitioner shall fumigate bee equipment in North Carolina unless the State Apiarist has inspected the fumigation chamber and method of fumigation for safety and efficacy and issued a fumigation permit.
(b) To receive a permit the applicant must:
(1) Have all licenses and certifications required by North Carolina law to conduct agricultural fumigations;
(2) See that the fumigation chamber meets all federal and state safety regulations;
(3) Provide security such that unauthorized people and animals will be kept away from the chamber while in operation and from cylinders of ethylene oxide gas;
(4) Have a system for safely dispersing used gas and for aerating fumigated equipment before release;
(5) Provide for marking fumigated equipment;
(6) Have fire protection and first aid equipment at site of fumigation;
(7) Have a system for preventing exposure of diseased equipment to bees and disposing of unfumigated products;
(8) Maintain records of fumigations performed and make records available on request to the State Apiarist.
