02 NCAC 48A .0220          OUT‑OF‑STATE AREAS MAY BE QUARANTINED

(a)  The Commissioner may quarantine areas outside of North Carolina when he has reason to believe that a bee of the genus apis other than apis mellifera, or a bee disease or disorder that is not established throughout North Carolina exists in that area and that importation of honeybees or beekeeping equipment present an introduction hazard to North Carolina beekeeping.

(b)  The following criteria shall be considered in establishing or revoking an out‑of‑state quarantine:

(1)           Evidence or data that the disease or disorder is not established or is under clean‑up areas in North Carolina;

(2)           Evidence or data that the unestablished disease or disorder occurs in the area proposed for quarantine action.
